Copyright Media Licensing Policy
Copyright Media Licensing Policy:
This policy is intended to provide clarity on the usage rights and restrictions pertaining to the Images provided by Taftpix LLC.
1. Copyright Ownership
All photographs, videos, floor plans, virtual tours, and media (“Images”) created by Taftpix LLC are the exclusive copyrighted property of Taftpix LLC, unless otherwise agreed to in writing.
Copyright is not transferred to the client.
2. Licensing Grant
Upon payment, the client (the listing agent, brokerage, or homeowner who placed the order) is granted a:
Non-exclusive
Non-transferable
Limited-use
Revocable
license to use the Images solely for the purpose of marketing the specific property for which the media was created.
This includes use in the Taftpix property website and marketing kit, and also the following:
MLS
Brokerage websites
Third-party real estate platforms (Zillow, Realtor.com, etc.)
Print materials
Social media
Email marketing
The license is valid only while the client is the active listing agent for that property.
3. License Restrictions
The client may not:
Transfer, sell, or assign the Images to another agent, brokerage, or third party without permission
Use the Images to market a different property
Use the Images after the listing expires, is withdrawn, or is reassigned
Alter the Images in a way that misrepresents the property or violates MLS rules
Provide Images to builders, stagers, designers, contractors, or vendors without approval
4. License Transfer
If the listing is transferred to another agent, Taftpix LLC may grant a new license to the incoming agent.
A transfer fee may apply.
The new agent must agree to all terms in this policy.
5. Additional Usage Rights
Any use outside of standard property marketing (e.g., portfolio use, advertising campaigns, long-term signage, builder marketing, print publishing, or commercial advertising) requires a separate commercial license with additional fees.
6. Expiration of License
The license automatically expires when:
The listing agreement ends
The client is no longer representing the property
The property is sold or rented
Continued or future use requires additional licensing.
7. Unauthorized Use
Any unauthorized use of Images—including reuse on future listings—constitutes copyright infringement and may result in:
Fees for extended licensing
Takedown notices
Copyright enforcement actions
8. MLS Compliance
Taftpix LLC supports MLS compliance rules.
If MLS requires removal or modification of media, we will assist promptly.
9. Archiving
We may retain and archive Images but do not guarantee long-term storage.
Clients may request re-delivery for a fee if still licensed to use the Images.
10. Model and Property Releases
It is the client’s responsibility to ensure compliance with any required property access permissions, homeowner privacy considerations, or model releases (if applicable).
The photographer is not responsible for obtaining homeowner consent beyond the client’s authorization.
11. Payments and Rights Activation
Licenses become active only after full payment is received.
Non-payment voids all usage rights.
